SDATAWAY SA may collect your personal data:

  • Directly from you. For example, when you apply for a job through our website, by email, and/or through related follow-up communications during the recruitment process.
  • Indirectly through other channels. For example, through professional recruitment firms or information collected from your references during the recruitment due diligence process.

As a job applicant, SDATAWAY SA collects the following categories of personal data about you:

  • Last name, first name, address, email, and telephone number;
  • Information and documents about you that you submitted when applying for a job, apprenticeship, or internship;
  • Your CV and cover letter;
  • Any additional information we may collect for recruitment purposes;
  • School and university education, internships, diplomas, and current professional background;
  • General information about your professional life;
  • Economic and financial information;

We may also contact third parties (e.g., a recruitment agency, references you may have listed in your application, previous employers, training supervisors, or clients with whom you have worked on previous assignments) to collect information about you when reviewing your application or profile. In accordance with applicable laws and regulations, we may collect information about you that is held by public authorities or organizations.

1.2. Purpose of the processing activity

SDATAWAY SA processes your data in whole or in part for the following purposes:

  • To review your job application;
  • To contact you regarding your job application;
  • To send you notifications about your progress and/or other vacancies that may be of interest to you;
  • To advance your job application;
  • To perform all tasks leading to the recruitment of a new employee, apprentice, or intern;
  • For candidate selection, the creation of a new candidate file, and the use of recruitment methods and techniques.

1.3. Recipients and subcontractors of data

Your data is processed by the individuals in charge of the recruitment process (usually line managers) who are responsible for evaluating your application. In addition, your data may be shared with any legally authorized authority, particularly when requested by a member of the judiciary, the police, or administrative authorities. Specifically, the above recipients will only receive the data necessary to fulfill the purpose of such communication.

1.4. Legal basis

We process your personal data based on our legitimate interest, in particular to find and hire new employees. The processing of your data is necessary to carry out pre-contractual procedures, namely to analyze your application and determine whether we wish to conclude an employment contract.

1.5. Disclosure

SDATAWAY SA does not disclose your personal data to third parties except upon written request from a legal authority in accordance with a legal obligation for the performance of its official duties, or if disclosure is necessary to protect your vital interests.

1.6. Retention period

If your application is unsuccessful, we will retain a record of your application in case you apply for another position with SDATAWAY SA (identity, date of application, position applied for, feedback) for a maximum period of two years.

With your consent, we may also retain your CV in our recruitment database if we believe your profile matches our future recruitment needs. In the latter case, your CV will be deleted from our database after two years.

1.7. Joint Controllers

When you apply through a third-party job portal, the solution provider’s data protection policy applies.

1.8. Data transfers

Your application details may be transferred to SDATAWAY SA’s servers hosted in Switzerland or to a third country that ensures an appropriate level of protection under Swiss data protection law.

1.9. Data protection measures

SDATAWAY SA implements appropriate technical and organizational measures to ensure a level of security appropriate to the risk involved.

2. Rights of data subjects

SDATAWAY SA wishes to ensure that you are fully aware of your rights as a data subject under Swiss data protection laws. Every job applicant is entitled to the following:

  • Access, modify, update, and correct the personal data we hold about them;
  • Request the erasure or restriction of their personal data via our contact address or exercise their right to data portability by the same means;
  • Withdraw consent previously given to process their personal data at any time.
